Terms of Service

1. Acceptance of Terms

By accessing or using SuperBrackets ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

2. Eligibility

You must be at least 18 years of age and a legal resident of the United States to use SuperBrackets. By using the Service, you represent and warrant that you meet these eligibility requirements. If you are accessing the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

3. Service Description

SuperBrackets is a free, web-based platform that allows users to create and participate in bracket pools for the college basketball tournament. Users can create pools, invite friends, fill out brackets, view real-time leaderboards, chat with pool members, and share bracket cards on social media. The Service is provided free of charge and is supported by its founders.

4. Entertainment Only Disclaimer

SuperBrackets is an entertainment platform. It is not a gambling service. No real money is wagered, won, or lost through the use of SuperBrackets. The Service does not facilitate, encourage, or support gambling of any kind. Users may not use SuperBrackets to organize or participate in any form of gambling, betting, or wagering. Any pools created through the Service are strictly for entertainment and bragging rights.

5. User Accounts

To access certain features of the Service, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

6. User Conduct

You agree not to use the Service to:

• Harass, bully, threaten, or intimidate other users
• Post or transmit content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Attempt to gain unauthorized access to the Service, other user accounts, or any computer systems or networks connected to the Service
• Use the Service for any commercial purpose or to solicit others for commercial purposes without our prior written consent
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use automated means (bots, scrapers, etc.) to access the Service or collect data from the Service
• Use the Service to organize or participate in gambling, betting, or wagering of any kind

7. Intellectual Property

The Service and its original content, features, and functionality are owned by SuperBrackets and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent. User-generated content (such as bracket picks, chat messages, and pool names) remains the property of the user who created it, but you grant SuperBrackets a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with the Service.

8. No Purchase Necessary

No purchase or payment is necessary to use SuperBrackets. The Service is provided entirely free of charge. There are no premium tiers, in-app purchases, or hidden fees. All features are available to all users at no cost.

9. Third-Party Services

The Service may contain links to or integrate with third-party websites, services, or content that are not owned or controlled by SuperBrackets. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that SuperBrackets is not responsible for any damage or loss caused by the use of any such content, goods, or services available on or through any such websites or services. We use third-party service providers including Supabase (database and authentication), Vercel (hosting), and Resend (email delivery) to operate the Service.

10. Limitation of Liability

To the maximum extent permitted by applicable law, SuperBrackets and its founders, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your use of or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Service; (d) any bugs, viruses, or similar issues transmitted through the Service by any third party; or (e) any errors or omissions in any content. The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

11. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the English language and shall take place in the State of Delaware. You agree to waive any right to a jury trial or to participate in a class action. Each party shall bear its own costs and expenses in connection with the arbitration, except that the costs of the arbitrator shall be shared equally.

12. Modifications to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised Terms.

SuperBrackets is not affiliated with, endorsed by, or sponsored by the NCAA or any member institution. Any references to college basketball teams, conferences, or the college basketball tournament are made solely for purposes of identification and information under nominative fair use. All trademarks, service marks, and trade names referenced on the Service are the property of their respective owners.
